Simon has enjoyed significant success with his TV Show “You’re Hired” where aspiring business professionals
compete for the role of CEO of his UK based TV Production Company. To expand the brand overseas he has
appointed Kim, a newly qualified lawyer and former celebrity as his new legal advisor as her high profile will
raise viewing figures and advertising revenue for the show.
To celebrate her appointment Simon takes Kim to dinner. At the restaurant, the owner shows them to their table
and takes their order. Kim asks the owner if the chicken dish contains peanuts as she is allergic to them and
the owner confirms it does not. Based on his assurance she orders the dish. Simon and Kim both enjoy their
meals but as they have an early start the next day decide against a desert and so Simon pays the bill and
takes Kim home.
On the journey to Kim’s house Kim becomes violently ill and Simon takes her to the nearest hospital where she
is diagnosed with anaphylactic shock from peanuts in the chicken dish. Kim has to remain in hospital for a
week and is unable to attend a photo shoot for a celebrity magazine for which she was to be paid £50,000.
By reworking your first submission, advise Kim
1) Of the responsibilities the restaurant owner owes to her under the tort of negligence AND
2) Of any remedy that she may have against him. AND
3) Of the consequences if she did not reveal her allergy to the restaurant owner AND
4) Write a 300 word reflective account in which you discuss how you have taken into account the feedback on
your first submission to amend your work, and how it now meets the Learning Outcomes
