In Canada, to be found guilty of a crime, the Crown or prosecution must prove actus reus and mens rea. Define and discuss these two concepts. Which of these two concepts do you think is more important in establishing someone’s guilt and why? What are the strengths and challenges associated with requiring both elements be proved for someone to be found guilty of a crime in Canada?
